We have been working with both chambers of Congress to improve the Post 9/11 GI Bill, particularly in making a housing stipend available to Vocational Rehabilitation and Employment (VR&E) participants. As a result of our efforts, the U.S. Senate passed S. 3447, the Post-9/11 Veterans Educational Assistance Improvements Act of 2010.
Disabled veterans need your help to get this legislation passed into law this year. DAV has testified in support of certain provisions of this bill. Resolutions adopted by our membership emphasize the need to provide veterans greater assistance under the VR&E program in Chapter 31 as contrasted to those participating in the post-9/11 educational assistance program under chapter 33. Section 205 of S. 3447 would allow veterans with service-connected disabilities that participate in a program of vocational rehabilitation under chapter 31 of title 38, United States Code, who are also entitled to Post-9/11 GI Bill education benefits, to choose whether to receive the monthly housing stipend payable under the Post-9/11 GI Bill or a monthly subsistence allowance.
DAV urges you to call on your Representative and request they take up the provisions of S. 3447 before Congress adjourns later this week, most likely on December 18. Please call your Representative or send a prepared e-mail today. Please emphasize the urgency of these provisions for disabled veterans. The University of Minnesota said Thursday its scientists may have identified an area of the brain that indicates a patient suffers from post traumatic stress disorder (PTSD).

Using a relatively new imaging technique called magnetoencephalography (MEG), researchers at the medical school and the Minneapolis Veteran Affairs Medical Center detected hyper electrical activity in the right side of the brain of PTSD patients who experienced involuntary flashbacks commonly associated with the disorder.

By confirming PTSD with the MEG scans, doctors can prescribe better treatments for patients, the school said. Scientists also move one step closer to identifying a biomarker, or genetic clue, to PTSD that allows them to measure the progress of the disease or the effects of treatment.

People often equate PTSD with military veterans who fought in wars, but the disease can appear in anyone who suffers severe psychological trauma. Symptoms include flashbacks, anger, anxiety and recurring nightmares.

Some people consider MEG technology superior to CT and MRI scans because MEG can measure the brain’s electrical activity in real time.

Orasi Medical Inc., a university-bred startup that’s developing software to crunch MEG data, says it owns the largest commercial database of MEG scans and is the only provider of MEG biomarkers.

In a previous interview, Orasi CEO Shawn Lyndon expressed interest in using MEG scans to diagnose PTSD.

Today, the company is primarily focused on helping drug firms determine earlier if their therapies are working by comparing the MEG scans of patients with neurological diseases to its image database of people with normal brain activity.

Orasi recently inked licensing deals with Swiss pharma giant Novartis AG and Danish drugmaker H. Lundbeck A/S.

The PTSD research, conducted by Dr. Apostolos Georgopoulos and Brian Engdahl, is published today in the Journal of Neural Engineering.

Via680 uses video to educate patients on visits, procedures

A Youngstown startup that set out to help businesses incorporate video into their communications has narrowed its focus on the patient education space — for now.

Two-year-old Via680 allows hospitals to create customizable online portals that pull together video, text documents and user feedback to help patients and their families prepare for upcoming hospital stays or procedures.

The software, called intelliSling, can take the place of three-ring binders stuffed with hundreds of printed pages of information about topics ranging from parking during a hospital visit to proper hand washing before surgery to what to expect after an operation. (The company was formerly known as BizVeo and owes its new name in part to the interstate that stretches through Youngstown.)

One key feature of intelliSling is a survey that patients are asked to fill out after watching their videos. If their answers indicate they didn’t understand a key piece of information, a notice is sent to a hospital administrator who can call the patient to clear up the confusion.

“It truly has changed the way you’re able to interact, exchange information and get patients on a course towards wellness,” said CEO Tony Deascentis, a veteran of another Youngstown technology firm Turning Technologies. Like Turning Technologies, Via680 is affiliated with the widely praised Youngstown Business Incubator, which has received some positive press recently from Inc. Magazine and Business Week.

So far the eight-employee company has garnered a handful of customers, most notably Youngstown-based hospital Humility of Mary Health Partners (HMHP).

HMHP has been using Via680′s software for about nine months with heart surgery patients, said Barbara Rombach, a practice manager for several groups at the hospital. HMHP uses the software to educate heart-surgery patients and their families about many details involved in the process, such as when to arrive at the hospital, and how family members should help patients get in and out of cars after the surgery.

“It’s a wonderful product and a great tool,” Rombach said. “It takes a lot of the scariness out of the whole process.”

With so much health-related “misinformation” a few clicks away on the Internet, Rombach likes that the software helps HMHP spread the correct clinical information to patients. The hospital likes Via680′s software so much, it’s planning to begin using it with orthopedics patients, Rombach said.

That’s no doubt music to Deascentis’ ears. But aside from signing up more customers, what really would excite him is luring some investment in the company. Via680 would use the cash to ramp up sales and expand to other industries, like banking and retail. “We’re looking for one or two angel investors to fuel our growth,” he said, though he declined to specify a targeted dollar amount.

Cardinal Health Q1 profits beat the Street, but sales slip

First-quarter profits for medical products and pharmaceuticals supplier Cardinal Health Inc. (NYSE:CAH) beat analysts’ expectations, though sales slipped slightly.

The Dublin, Ohio-based company reported first quarter earnings of $295 million, with adjusted earnings per share of 64 cents. Analysts had expected earnings of 53 cents per share. In last year’s first quarter, Cardinal reported a net loss of 11 cents per share, mainly due to charges taken for the spinoff of medical technology firm CareFusion Corp.

In another bit of good news for Cardinal investors, CEO George Barrett said the company expects to finish 2011 at the higher end of its forecast of $2.38 to $2.48 earnings per share. The company’s shares rose about 2 percent to $34 in early trading Thursday.

Revenues fell 1 percent to $24 billion, compared to last year’s first quarter.

It was mixed news for the company’s pharmaceutical segment, which saw sales drop by 1 percent to $22 billion. The company blamed the drop on reduced sales to existing bulk customers and contract terminations from two large customers.

However, sales of generics, which rose 19 percent, were a significant bright spot for the company, and that strength could continue. “Our generic penetration continues to be a focus,” Barrett said in a conference call with analysts.

Profits in the pharmaceutical segment jumped 42 percent.

The numbers weren’t quite as rosy for the company’s medical products segment, which saw revenues drop 3 percent and profits plummet 28 percent. Barrett attributed the declines in part to “sluggishness” in demand for elective procedures, though he said he was “guardedly optimistic that value will recover.”

During the call, one analyst premised a question on the notion that Cardinal’s medical segment was “clearly struggling,” but Barrett shot back, “We’re not struggling at all.” The company also blamed an unusually strong flu season last year and the loss of revenues from CareFusion as contributors to the declining numbers.

Bernstein analyst Helene Wolk wrote that sales in the medical segment were slightly below expectations, Reuters reported.

Journey of a whistleblower… to $96M award (Morning Read)

University of Minnesota startup to attack vein disease in legs

When Mike Selzer first reviewed the work of University of Minnesota scientist Dr.Erik Cressman — a way to kill cancer cells in the liver using chemical-generated heat — the veteran medical device executive was impressed.

Cool technology, he thought. Terrible idea for a company.

“You can’t build a company around [liver cancer],” said Selzer, an adviser at the time to the school’s Venture Center, the unit of the Office for Technology Commercialization responsible for spinning out companies from university technology. “It’s just not a large market. It was one of those things where there was really good technology. But the commercialization wasn’t as obvious.”

Normally, Selzer says, university researchers invent stuff but have no idea what to do with it. In Dr. Cressman’s case, the aim was too specific.

“The university doesn’t have a lot of entrepreneurs,” Selzer said. ‘There are only a few, select people who really get it.”

Ultimately, Selzer identified a large market for the technology — chronic venous insufficiency (CVI), a blood vessel disorder in the legs.

Earlier this month, the school officially spun out XO Thermix Medical Inc., the latest addition to a growing stable of university-bred medical startups, including MiroMatrix Inc. and Hennepin Life Sciences.

CVI, a common condition that primarily affects women, especially pregnant ones and patients who stand frequently, occurs when faulty valves in the legs prevent blood from returning back up to the heart via veins. As a result, blood pools in the lower half of the body, causing swollen legs, skin discoloration and painful ulcers.

So instead of targeting cancerous liver cells, XO Thermix hopes to use Dr. Cressman’s chemical ablation technology to kill diseased vein tissue causing the blockage.

Medical device companies are widely exploring using heat, radio frequencies, lasers, and even cold temperatures to treat a host of cardiovascular diseases.

In August, Medtronic Inc. (NYSE:MDT) won approval from Canadian regulators to sell its Ablation Frontiers Cardiac Ablation System, which uses radio frequency energy to kill diseased tissue that causes the heart to quiver or beat abnormally, a condition known as atrial fibrillation (AF).

Medtronic also paid $380 million to purchase CryoCath Technologies Inc. in 2008. The Canadian company makes catheters (tubes) and balloons that can deliver subzero temperatures to the heart. The technology restores normal electrical signals by freezing the tissue or pathways behind the irregular quivering.

Here’s where XO Thermix stands out, Selzer said. Normally, doctors need large, expensive equipment to create the necessary energy to target and destroy diseased tissue without harming the patient.

What Dr. Cressman essentially created is a cheap and quick way of generating heat by mixing together certain chemicals. Doctors deliver the chemical cocktail to the vein walls through a catheter-based balloon system.

The chemicals in the balloon grow hot enough to kill the diseased tissue and then form a harmless substance after they complete the job.

The technology “is a simple, fast and easy way to create ablation,” Selzer said. “You don’t have to mess around with that other stuff (lasers, probes). It’s a shorter procedure, which reduces the cost of treating CVI. We can put this thing anywhere.”

If anyone has experience in evaluating technologies, it’s Selzer.

In 2007, the former CEO of Urologix who once headed Medtronic’s neurostimulation business founded ConcepTx Medical with prominent local medical device entrepreneurs Dale Spencer and Mike Berman. ConcepTx’s goal was to accelerate the development of promising technologies from struggling startups.

The company quickly won a $4 million investment from venture capital firms Versant Ventures and Advanced Technology Ventures. But the country’s economic collapse a year later made things too difficult.

“No one wanted to put down any long term money,” Selzer said. “I didn’t think we were going to make progress fast enough.”

So Selzer sold his share of ConcepTx and eventually found his way to the university’s Venture Center as a CEO-in-Residence.

Selzer has high hopes for XO Thermix as a platform technology. If successful with CVI, the company hopes to apply its ablation technique to kill solid tumors in patients suffering from liver, prostate and breast cancers.

However, several challenges remain. Sticking a potentially dangerous mix of chemicals into the body is no easy matter — the company must make sure the chemicals don’t leak from the balloon once they generate the heat.

Also, the mechanisms of CVI are still largely unknown, experts say.

“The pathophysiology of chronic venous insufficiency is not well understood,” according to a report in the New England Journal of Medicine. “There have been few randomized comparative trials; available data are limited by the previous lack of both disease classification and measures of clinical severity”

Doctors may not even know what to target, the report says.

“In addition, quantitative methods are lacking to measure reflux or obstruction at individual valve stations and vein segments in order to selectively target the correction of these abnormalities,” the article said.

XO Thermix hopes to start raising angel money in two to three months, Selzer said.

Historic Veteran Caregiver Legislation Passes House The House of Representatives gave final approval to S. 1963, the Caregivers and Veterans Omnibus Health Services Act, which provides an array of supportive services to family caregivers of disabled veterans, including up to $1.7 billion in caregiver benefits to financially strapped family members caring for the most severely wounded and disabled Iraq and Afghanistan veterans. The legislation, which was first proposed more than two years ago, and has been strongly backed by DAV and other veterans organizations, now goes to the Senate for their approval. New Services for Women Veterans, Rural Veterans and Homeless Veterans S. 1963 also expands and improves health care access and services for the nation's 1.8 million women veterans, veterans living in rural areas, and homeless veterans. Once enacted into law, the legislation will help ensure that women veterans, who have played an increasingly essential role in our military, receive quality, timely and gender-appropriate health care services, and will for the first time allow VA to provide seven days of care to newborn infants of women veterans. About the Stand Up for Veterans Initiative Stand Up for Veterans is an initiative of the Disabled American Veterans, an organization of 1.4 million disabled veterans who are focused on building better lives for disabled veterans and their families. WSJ: Obama and Shinseki now pressuring Veterans toward Euthanasia

The Wall Street Journal just published a shocking editorial written by a respected University President, confirming the Obama Administration is now using VA hospitals to order doctors to pressure all military veterans to sign "pull the plug" do-not-resuscitate orders, hastening their premature deaths through mandatory "end of life" counseling.

President Jim Towey of Saint Vincent's College, founder of the non-profit "Aging With Dignity" and former White House Director of faith based initiatives, wrote a blistering expose entitled "The Death Book For Veterans," revealing President Obama's new Veterans Administration (VA) directive, presumably signed by VA Secretary, General (ret.) Eric Shinseki, which mandates all veterans' primary care physicians must graphically discuss "end of life planning" with all VA patients (not merely those nearing death), and must refer them to "Your Life, Your Choices," a book that openly encourages Euthanasia and was written with guidance from the group formerly known as the Hemlock Society. That same pro-suicide group now boasts on their web-site of directly leading the charge to ensure "end of life counseling" is mandated in the Obamacare bill, HR 3200.

On page 21 of the Shinseki-mandated Veteran's Euthanasia book, all military veterans are encouraged to complete a checklist of various scenarios, to decide whether their own life would be "not worth living." For example, the booklet asks veterans 7 questions pressuring veterans to sign a "living will" that authorizes doctors to terminate your life, if you are:

1) Living in a nursing home?

2) Being in a wheelchair?

3) Not able to "shake the blues?"

4) Ever heard anyone say, "If I'm a vegetable, pull the plug?"

5) No longer able to contribute to your family's well-being?

6) Are you a severe financial burden to your family?

7) Do you cause severe emotional burden for your family?

"This hurry-up-and-die message is clear and unconscionable," says Towey, "Worse, a July 2009 VA directive [presumably signed by Shinseki] instructs its primary care physicians to raise advance care planning with all VA patients and to refer them to 'Your Life, Your Choices.' [the Euthanasia booklet.] Not just those of advanced age and debilitated condition—all patients. America's 24 million veterans deserve better." Towey recommends a "five wishes" living-will document that does not pressure suicide.

But instead the Hemlock Society booklet is now MANDATED for doctor referral to all patients in all VA hospitals, heaping more evidence upon the growing list of proofs that the Obama Administration is LYING TO THE PUBLIC by denying their health care plan pushes Euthanasia on the elderly. They already do it today. Just imagine if ALL hospitals become government-run like the VA.

OBAMA ACCUSES HIMSELF AND FELLOW DEMOCRATS OF LYING

Obama held a conference call with reportedly 140,000 members of the "religious left" and accused himself of lying, saying that anybody who claims his health care plan funds abortion violates Exodus 20:16, "thou shalt not bear false witness." But Obama knows his fellow Democrats supported the Capps Amendment to HR 3200 funding abortions through an accounting-scheme, and defeated pro-life amendments prohibiting abortion funding. On July 17, 2007, Obama himself told Planned Parenthood, "in my mind, reproductive care [abortion] is at the center and at the heart of the plan that I propose. [My] plan…will provide…reproductive services [abortion]." It now appears Obama is calling himself a liar, since he personally believes his own plan must contain funding for abortion.

The Capps Amendment has a Section 4B that reads: "Abortions for Which Public Funding Is Allowed. -- The services described in this subparagraph are abortions for which the expenditure of Federal funds appropriated for the Department of Health and Human Services is permitted..." As the Washington Times analysis says, "You can't get more explicit than that." But Obama calls a liar anybody who reads the bill aloud, verbatim.

Obama further accused as "bearing false witness" anyone who claims his plan will result in "death panels" that ration care to the young at the expense of the elderly. That must first include his own Democrat White House Health Policy Advisor, Ezekiel Emanuel.

In an article entitled "Deadly Doctors," The New York Post just confirmed from Democrat Emanuel's own writings, the White House plan prefers "communitarianism" which should guide decisions on who gets care. Emanuel says medical care should be reserved for the non-disabled, not given to those "who are irreversibly prevented from being or becoming participating citizens . . An obvious example is not guaranteeing health services to patients with dementia" (JAMA, Feb. 27, 2008). NY Post's translation: "Don't give much care to a grandmother with Parkinson's or a child with cerebral palsy." Grandma's memory slipping? Obama's Death Panel convenes to de-fund her care. Emanuel said so, read his quote again, confirming Sarah Palin and Newt Gingrich were right after all.

Emanuel explicitly defends discrimination against older patients: "Unlike allocation by sex or race, allocation by age is not invidious discrimination; every person lives through different life stages rather than being a single age. Even if 25-year-olds receive priority over 65-year-olds, everyone who is 65 years now was previously 25 years" (Lancet, Jan. 31). EXCUSE ME? Obamacare funds 25 year olds, but excludes 65 year olds? RATIONING, DEATH PANELS, SMOKING GUN. Don't accuse conservatives of bearing false witness, Mr. Obama, until you first accuse your own Health Policy Advisor.

This quote is direct proof that Obama's COMMUNITARIANISM (like Socialism only bigger, on steroids, like Communism), favors treating the young at the expense of the old.

1) More Proof EUTHANASIA is pushed by Obama's socialist government "health" care.

President Obama had been confronted by a North Carolina woman asking if "everyone that's Medicare age will be visited and told they have to decide how they wish to die."

In response Obama joked morbidly about euthanasia, that he hadn't yet hired enough bureaucrats to conduct such an operation, yet he could not deny the New York Post's discovery the House bill "compels seniors to submit to a counseling session every five years (and more often if they become sick or go into a nursing home) about alternatives for end-of-life care" (pages 425-430). In other words, your grandmother will be told, when insufficient resources are rationed to young people, that her duty to die begins with mandatory "end-of-life counseling," or as Obama explained, "encourage the use of living wills" that terminate otherwise salvageable lives prematurely through signed "do not resuscitate" (DNR) legal releases that authorize "pulling the plug" on Grandma.

The White House made a quick video to refute claims of euthanasia in the health care bill, but interestingly they deleted Obama's quote about living wills, and AARP sent emails claiming rumors about euthanasia in the bill were generated by conspiracy theorists. But then a respected bioethicist wrote a scathing editorial in the Washington Post, confirming that euthanasia is initiated by the government in the bill. Lane writes:

"Consultations envisioned in Section 1233 aren't quite 'purely voluntary.' To me, 'purely voluntary' means 'not unless the patient requests one.' Section 1233, however, lets doctors initiate the chat and gives them an incentive -- money -- to do so. Indeed, that's an incentive to insist. Patients may refuse without penalty, but many will bow to white-coated authority. Once they're in the meeting, the bill does permit 'formulation' of a plug-pulling order right then and there."

Lane agrees the legislation mandates the doctor 'shall' discuss living wills and durable powers of attorney, and their uses: "Section 1233 goes beyond facilitating doctor input to preferring it. Indeed, the measure would have an interested party -- the government -- recruit doctors to sell the elderly on living wills, hospice care and their associated providers, professions and organizations. You don't have to be a right-wing wacko to question that approach" says the Washington Post.

Bankrupt state can't afford to pay for grandma's hip replacement? Obama's plan turns her doctor into a lawyer, paid by Uncle Sam to persuade her to sign a DNR, explaining her hastened duty to die, and obtaining her signature legally absolving him of all guilt. Lane says he personally has a living will, but doctors shouldn't be paid extra by the government to push them on seniors. Euthanasia begins when socialism replaces capitalism.

AARP LYING TO SENIORS TO PROFIT FROM OBAMACARE?

The seniors advocacy group AARP defended Obamacare, stating in emails to seniors: "FACT #3: There is no provision of any piece of legislation that would promote euthanasia of any kind. The rumors out there are flat out lies...It is not mandatory and it has nothing to do with euthanasia." But since the House bill includes the legal term "shall," the Dean of Liberty University School of Law Mat Staver disagrees. "I just went back and re-read the bill. The end-of-life counseling is mandatory and there is a 5 year requirement that it must occur every 5 years. The bill is on our website and people can read it for themselves. It is not new that AARP favors killing their own members. They...do not have the best interests of their members in mind."

Attorney Matt Barber of Liberty Counsel had stronger words. "AARP is lying. See pages 424, 425 and 426 of HR 3200. The government 'consultation' that seniors 'shall' get if they have 'not had such a consultation within the last 5 years' is clearly designed to encourage them to get out of the way and to just go ahead and die already."

Widely respected Minister Rick Joyner wrote, after reviewing Mat Staver's detailed analysis of H.R. 3200 "Health" care bill, voicing his strong opinion that this bill "is about euthanasia, the power to determine who lives or dies in America. Hitler and Stalin would have loved to have had a means such as this for dispatching the millions they killed—it would have made their job much easier, and probably given them the ability to kill many more than they did. THIS BILL IS THAT SINISTER. This is not a joke."

2) Tax-payer funded ABORTION on demand is another guaranteed result.

Last week several so-called "pro-life Democrats" executed a bait and switch that will fully fund abortion on demand in the new Obamacare "health" bill. Led by compromiser and ex-pro-life Congressman Tim Ryan (D-OH), who was recently booted as an advisor to Democrats for Life of America for his lack of principle, the liberal House Democrats overruled conservative Republicans 30-28 to pass the hideous "Capps Amendment" to H.R.3200 in the Energy and Commerce Committee. This amendment now deceptively creates a phony accounting scheme that gives the false impression your tax-payer dollars will not subsidize abortion, while it simultaneously nationalizes free abortions for low-income urban neighborhoods, fulfilling the dream of Margaret Sanger (and her protege Ruth Bader Ginsburg) that African American babies will be the first exterminated in the government funded ovens that weed out "Populations that we don't want to have too many of."

Rep. Chris Smith (R-NJ) explained the Capps Amendment: "It's one of the most deceptive amendments I have ever seen. The bottom line is that money is fungible, and the plan itself will be subsidizing abortion-on-demand, with taxpayer funding commingled, and the numbers of abortions will go up significantly."

3) Obama will REMOVE Christian prayers and symbols from Government-run hospitals

The hostile socialist government takeover of Catholic or Christian hospitals will eventually result in atheistic silencing of religious expression (and removing all Christian symbols) from the very place where faith in God is critical to sick and dying patients. For example, look at the Veterans Hospitals, already government-run, who are busy removing crosses and Christian symbols from their chapels (like in Iowa), because easily-offended atheist complainers have successfully intimidated hospital administrators with threats of lawsuit, by demanding separation of church and state. Just imagine more atheist lawsuits, when all Catholic and Christian hospitals are seized in the same way Obama took control of General Motors, inviting easily-offended atheist complainers to demand we change the name of the hospital from "St. Luke's Memorial" to the "Obama Government" hospital, falsely claiming tax-dollars cannot subsidize religion. But if St. Luke's refuses government subsidies, they will be drummed out of business, and Christian doctors' licenses revoked.

Can a government-run hospital still allow Christian chapels, or pay Christian chaplains, or permit Christian doctors to pray Christian prayers with their willing patients, or even allow Christian parents to control the health care options forced upon their dying children? Just ask Florida Hospital Chaplain Danny Harvey, fired last year from Leesburg Regional Medical Center because he prayed "in Jesus name" at a public memorial service. Ask Christian Pharmacists who Washington has already forced to dispense "Plan-B" abortion pills against their conscience, or doctors denied a "conscience clause" to opt out of abortions when Obama refused to renew Bush's pro-life executive orders. Ask Nurse Catherina Lorena Cenzon-DeCarlo, who recently was forced to participate in a second-trimester abortion against her will, and is now suing Mount Sinai Hospital in Manhattan for "blatantly" violating her rights under a 35 year old federal law that protects health care workers with religious objections from being forced to assist in murderous abortions. Ask Pentecostal Ministers Dale and Leilani Neumann, who were charged with second-degree murder of their 11-year-old daughter, because they refused to trust the power of a government hospital to heal their little girl who tragically died with diabetes. Can you say mandatory godlessness in "health" care? If government has power to dictate your health care options, they also have power to seize your children when you refuse. Think about it. Will you dare refuse the H1N1 vaccine when ordered to poison your children? No religious exemptions for doctors, patients, or parents are readily apparent in the current Obamacare bill. So take action with me...

So let me summarize Obama's health care plan: 1) Euthanize grandma and veterans, 2) Mandate funding murder of innocent children, then lie about it in denial, 3) Empower atheist litigants to outlaw the healing power of the Christian faith.

Now Obama and his liberal Democratic House allies want to replace your doctors with bureaucrats, hasten grandma's demise, abort and kill children in urban neighborhoods, cut doctors' pay and control their religion, and transform Christian hospitals into government-controlled atheist bureaucracies. While angry folks with legitimate concerns or hidden agendas were busy shouting at politicians at televised town-hall gatherings this week, a court hearing held on another critical health care debate drew scant attention.

Oral arguments were heard Wednesday before a federal appeals court in California in connection with a 2007 class-action lawsuit filed by two veterans advocacy groups — Veterans for Common Sense and Veterans United for Truth.

You should. It's about the plight of the men and women we send into harm's way. It also has a strong Minnesota link. Here's a quick overview:

The suit alleges that the Department of Veterans Affairs' inability to handle disability claims in a timely or expedient fashion is so dysfunctional that it violates veterans' constitutional and statutory rights. The backlog — a good number of unresolved claims dating to the Vietnam War — may surpass the 1 million mark this fall, according to estimates from veterans advocates. The VA places the backlog at a lower but still hefty 463,000.

The lawsuit also alleges that the VA has been derelict in its legal duty to provide immediate, competent and effective care for military members grappling with post-traumatic stress disorder and thoughts of suicide.

"Justice delayed is justice denied, and that's what we essentially have here," said Gordon Erspamer, a Grand Rapids, Minn., native and Hamline University graduate. "For all these disabled veterans,

One of the key reforms pushed by the Obama Administration is to move away from paper medical health records to paperless, electronic systems. Electronic records should reduce costs, improve diagnoses, and are a key part of future telehealth hopes.

But what are the rules governing these systems? Can some vendors build systems and lock hospitals into proprietary formats from which they will be unable to transition away?

Fortunately, there is an open source solution that has already been built with public money by the Department of Veterans Affairs.

West Virginia did it on the cheap by using an electronic medical records system built by the Veterans Administration with taxpayer dollars, saving millions in software licensing fees charged by commercial software vendors. The VA software, known as VistA, is open-source software - its code is freely available to the public and is constantly being improved by users - and it includes important features, such as a bar-coding system to track drug dispensations, to help improve patient safety.

However, many hospitals are still not using it in the United States.

Some policy makers are working to change that. Senator Jay Rockefeller, a West Virginia Democrat who chairs the Finance Committee's health subcommittee, is introducing legislation that would promote the widespread adoption of VistA and other open-source systems among hospitals that serve the poor. He also successfully pushed to include provisions in the stimulus bill to make VistA more accessible.

Though VistA does not yet have the features needed by all hospitals, it is an example of one option that communities have to ensure they will not become dependent on vendors in such an important area of their operations.

On this Memorial Day, it is my great hope that you will take a few minutes of your time to reflect on what an honor it is to live in our great country and remember the men and women in our nation's armed services - those who are willing to give the ultimate sacrifice to protect our freedoms as Americans.

Last Friday, I had the great pleasure of spending time with the Midshipmen and their families at the commencement ceremony of the U.S. Naval Academy. These young men and women are a testament to what it means to serve a cause greater than self.

As we take a moment to remember those who have fallen in defense of our Nation, please keep all of our service men and women and each of our veterans in your thoughts and prayers today and every day.

Just doing their duty in times of direful war
Who the mantel of heroes bore.
Remember boys who fought humanity’s good fight
Who battled, stouthearted and bold, for right.
Worship at their alter of liberty
That the flower of youth in finest hour’s nobility
Will live on in cherished memory...

Remember these holy vessels by our father's sanctified
Sent to war with pomp and ceremony glorified
Bearing terrible sword’s of swiftest lightning
A valiant place in annals of history earning
For age shall not defeat them
Assailing enemies no longer have power to condemn

Ask a veteran about Hell and High Water

Veterans gave their very best

Veterans don’t take no guff,

Veterans are the reason Americans walk free
Enjoying life through eyes seeing only liberty.

Veterans learned lessons of war in jungles greening black
In desserts or icy cold refusing to slack
Fought back rushing adrenaline
Facing their personal Armageddon
Waiting under fire for a virulent foes attack
Learned to watch a buddies back.

Veterans humped a sweet and sour perfumed park,
Fending off specters of death, dawn into dark
Rivers of sweat washing their soul
Dancing to death’s grim rock and roll
War made boys before their time grow old
Unless dying a hero in actions swift and bold.

Veterans dreamed of sweethearts to have and to hold
Suffered fevered chills from bones weary cold
Fighting wicked elements wills sapping
Unbearable Heat Suffocating
Monsoon rains spirits Drenching
Enduring rice paddy mud overpowering.

Old Veterans faced enemies preoccupied with his death
Still fear often that final breath
Still gaze on the world with blank stares
That cruel war on their soul still bears
Remembering the battle’s fiery combustion
Bearing Sodom and Gomorrah like conflagration.

America's veterans have seen
Agent Orange's virulent scene
Brought creeping to their families obliteration,
Delayed traumatic stress’s lingering destruction,
Horrendous nerve gas distillation,
Mankind’s Nuclear Holocaust proliferation.

Salute now our veterans who great honor bore
Who with brave distinction peace restore
Who’ve been there/done that, know the score
Who've gone above and beyond to perform that dirty chore
Offering their lives protecting generations from reality of war
A ritual sacrifice venerable veterans vehemently abhor.

This combat soldier's prayer,
Who has served his time in Hell,
Is may we learn the lessons of war well,
That we not doom future generations,
The same old tales of horror to tell,
To endure what in youth they see mistakenly as glory.
Oh God, do not let our children
Repeat the same old story.

Make it so that America's babies live to grow old
In this land of the free and the bold.
Help us throw off the shackles of hate that bind
And grow old in a life of a peaceful kind.

Teach us that there is no glory in war,
Nor honor there that brave men should not abhor.
Teach us instead, one for another our brothers to love.

But if I should die on some far, far away battlefield

County Offices move from Government Center West to Plato Blvd.

Staff from three Ramsey County departments located in the Government Center West building are moving across the river to 90 W. Plato Blvd. The departments include:

Veterans Services, #210, 651-266-2545 (New phone number);
Emergencey Management/Homeland Security, #220, 651-266-1020; and
Saint Paul - Ramsey County Department of Public Health, #200, 651-266-2400

The new offices will be open for business on Tuesday, May 26th.

Many Americans rightfully signed petitions demanding that Napolitano be fired.

The truth is that Janet Napolitano is threatening Americans who disagree with the policies of the Obama administration to "Shut Up or else."

Astonishingly, her intelligence Assessment admitted that DHS had no information on any plans of violence by so-called "rightwing extremists."

Indeed, this is the first step toward tyranny. Please join me to stop it!

Clearly, Napolitano's Assessment will be used as a tool to stifle political opposition to the policies of the Obama administration. Patriotic Americans profiled in her Assessment as rightwing extremists and potential terrorists will undoubtedly be reported to the police by their opponents. You can imagine what will happen next.

This is one of those times when patriots must defend their country from their own government.

Would you ever have imagined our Homeland Security Secretary profiling as potential terrorists our returning veterans from Iraq and Afghanistan, who placed themselves in harms way, to defend our country and constitution?

And why is she so willing to use the word "terrorist" to describe law-abiding Americans when she refuses to use that word when speaking about the real terrorists?

Why has Janet Napolitano diverted public attention from the real domestic terrorists, the Radical Muslims in our midst?

Would you ever have imagined that our own government would target citizens based solely on their political and moral beliefs?

This will be a tough lawsuit. We will be opposed by the vast resources of the federal government.

Make no mistake: This will be a David versus Goliath fight.

So America needs your help.

We are receiving hundreds of emails from outraged Americans offering support and even requesting to join the lawsuit.

Here's an email from a retired veteran which sums up the feeling of most:

"As a 22-year retired and disabled veteran, I would like to thank you from the bottom of my heart for standing up for the rights and freedoms of all veterans and law abiding citizens of our great country. I was personally offended after reading the DHS summary threat assessment for "right-wing extremism." I served my country with all of my heart and soul and feel this administration has violated everything I stood up for by this action. I continue to uphold my oath! Maybe they should consider upholding theirs."

Our lawsuit was filed in the U.S. District Court for the Eastern District of Michigan on behalf of nationally syndicated conservative radio talk show host, Michael Savage, Gregg Cunningham (President of the pro-life organization Center for Bio-Ethical Reform), and Iraqi War Marine veteran Kevin Murray.

The Law Center claims that Napolitano's Assessment has chilled the Constitutional rights to free speech, expressive association, and equal protection. And we have asked the court to permanently enjoin its application.
